Wrong witness included in cheque and money fraud case
« on: May 07, 2016, 02:11:01 PM »
Hi,
A relative has included my brother's name in a money fraud case as a witness and mentioned that fraudster has taken money from my brother alongwith my relative's money.
But my brother neither gave any money nor he was a witness of any transaction and also he was never informed and never taken permission to include his name for any such case filed against someone.

How to remove his name from the case?

Or no need to bother as there won't be any signatures from him in the court papers being a legal witness?

What to do if relative doesn't agree to remove his name, do we need to prove in court of no involvement?

Appreciate your kind advice before we approach anyone.

Dear Sir,

Please tell your brother to appear and support the case of your relative as his name is already given as witness. If he will now turn back then it may adversely affect the case of his relative for giving false witness or if the witness will turn hostile.

Or your brother can simply appear before the court and say that no such transaction has happened with your brother with the accused person and there may have some confusion.
