Divorce procedure-Alimony amount

Hi
I have been married for over 2 years, there have been constant understanding issues between me and my husband from day 1. He has a travelling job so i used to stay with his father alone in the house for more than a year. A lot of misunderstandings happened between me, my husband and his family. In between numerous times i was asked to leave his house at odd hours of the day and couple of instances of physical abuse too happened for which i have photos as proof.

Now the situation is my husband stays in a different country i stay in another city where i work and we have not been communicating for over 6 months. Financially i am independent , my husband earns double the amount of what i do. What are the grounds on which i can file for divorce and am i entitled to claim any one time alimony money. My parents have already spent a lot on my wedding and as gifts to his family. Also he is in india right now for 10 days only so i want to take a step asap.

Let me tell you that filing divorce petition is not a joke or child's play. You have not described in details what is the dispute from the day 1 with your husband and in-laws. This is open forum and I cannot force you to explain your matrimonial matter in details.

You have option to file divorce petition after expiry of one year from the date of marriage under specific ground. i suggest to go for cruelty ground. you can also file a maintenance case where you can claim half of his salary as your monthly maintenance. Claiming for permanent alimony is not correct time.

Dear Ma'am,

Before filing any case if you are keen on taking divorce then please speak to your husband for taking divorce on the grounds of mutual consent. You may also speak to him about one time settlement amount and other terms and conditions of divorce.

If husband is not ready for mutual consent divorce, then you may file a divorce on the grounds of physical and mental cruelty against the husband. Which will be filed Under Hindu Marriage Act. I hope the marriage is already older than one year now so you can file for divorce on any of the grounds. For mutual consent petition, there has to be one year of separation prior to the filing of divorce.
