Hello Sir,

My name is Sumalatha am from Hyderabad. I completed my MBA and I got marriage in 2014. We both stayed together only 2 months. After that, my husband left me in my mother's house. From that day to till now am in my mother's house. He comes to my home once in 6 months when I ask him he says he still needs time to take me and always gives excuses like he is jobless and has financial problems etc and avoids me to take me with him. I don't know the address of my husband and where he is staying or what he is doing. He just calls once a week and talks with me about his problems only, just because of him I am sitting ideally without doing any work and waiting for him. My age is 26 and all are talking bad about me what is her life. Just because of me my parents also suffering a lot and all are laughing at us. Why my life became like this I do not and all my relatives everyone in society asking me about my husband but I don't have an answer.

We are from a small family and financially we are very poor we don't have any elders to take proper suggestion in which way I have to go or what is my future. My situation is hopeless and  I Don't know what to do, shall I still wait for him or take divorce or have to leave this world.

Please suggest me.

Dear Suma,

Please file  a police compliant for cheating against your husband. This will help you to get to know your husband address and other details. Please do provide the phone number of your husband and entire details.

Once you get to know the address and other details of your husband through police in the complaint. Then you may file a petition for Restitution of Conjugal rights against the husband to join your company and perform the matrimonial obligations. I am unable to come up with any other solution under your situation as you don't even know the address of your husband.

Sir,

I don't know my husband address but he is staying in Bangalore and his parents stay in Hyderabad and he is not even coming to their parent's house from so long, when we ask their parents they are saying their son is not coming to their home as well and not in contact with them but I came to know he is in contact with their parents. Last year we went to women police station to complain but they called my husband to police station and they gave counselling for both of us that time he agreed to take me with him next week but till now its 1 year past after counselling he is still not taking me.

Please suggest what steps I need to take.

Dear Suma,

Please file your complaint in women police station again. Follow the same with restitution of conjugal rights petition before the concerned family court. As if now do this, lets see if your husband is ready to work out the marriage.

Please remember even by filing RCR, you cannot force your husband to keep you if he is not willing to do so.

Hi
First file a Restitution of conjugal rights petition in the court.
Since you know the residence of your in laws, that is sufficient for you to file a RCR.
Police will only counsel. but till such time you file and RCR and also ask for maintenance,  it appears that your husband and your in laws will not take you back in to your matrimonial home.
Husband cannot escape maintenance even if he is unemployed.
you can also seek attachment of properties in case maintenance is not paid.
unless you take severe action,the other side will not listen.
