Hi There,

One of my court judgments is appearing online on the internet and I want to get rid of it. Although the case was was finally taken back by the other party, one of the related judgments is still appearing online. I know that there is a procedure that if court gives the order to not to make the judgement public this can be removed from the internet. I just need your advice on how to start on with the process. Can this be done? If yes, what's the right way to begin with.

Dear Sir,

The Judgment must be appearing on some or other domain. If the said judgment was reversed then you may approach the domain and request to upload the other which is in your favour, both will show on the domain.

Hi Jai,

Thanks for your reply. The case was taken back by the other party and thus it was dismissed. There is no court order for that.

Also, even if there was a court order proving the innocence, I would still not like to publish anything on internet. All I want is to just remove it from the internet, whether it's in my favor or against me. I did read somewhere that the court that issued the order can pass another order to not to make the information public. Can you please confirm if that's the case and what's the best way to go about it.

Thanks.

Dear Sir,

Please let me know where this Judgment is posted, which domain. If this is related to court websites or legal research websites then it cannot be removed.

As far as I know, judgement are public documents and hence available to anyone. Even a third person is entitled to receive a copy of the judgement if they apply through proper procedure. It does not matter whether the judgement was in your favour or not. I do not think you can bring a restrain order on that unless there is an issue of copyright of the content, which I think is not possible.

Thanks for the replies.

But if I take a look at the websites that have it they say that it can be removed. Have a look at the "Can you remove my court case?" section at this website.

https://indiankanoon.org/court_case_online.html

A short excerpt from the above

"If you want information deleted, your only recourse is with the courts that issued the opinion. You should contact the court directly or hire a lawyer to do so for you."

Any final comments from anyone.

I am getting contradictory replies from different sources. Not sure what is the right way here.
