Terminated ,on Notice period and legal action

Hi,
 I am working for a software company in Mumbai. The background is as follows

The company terminated me and on notice period. They asked me to return the laptop, which before returning I removed the information becuase i was sending via courier to company and for keeping it safe. Now my company is saying I have deleted all the data and there is loss for company - they are also saying
1) I have to pay for the loss of data in my device
2) If not they will take legal action
I had told them that data is already available in company network and emails are available in the mail server. However, they are saying only 20 days information of email is there and company has archived it.

Can they take action on me now for this incident ?

First you have to see whether your termination on notice period is valid. If the termination is illegal then you can challenge the termination and seek reinstatement and back wages.

Secondly, depending on the exact nature of statement made by the company on the data loss, a reply has to be sent. It is advisable that such reply is drafted by a lawyer. If they can prove that you have intentionally destroyed any data then they can ask for compensation. However, they are required to prove everything before the court of law. Give a proper reply to them from legal point of view.
