Employer not paying salary - I am highly depressed.

Hi ,

I am working in an IT company (SME), In gurgaon. I have been working in this particular company for 2 and a half years. My performance has been fairly good due to which i got a decent raise in January. All of a sudden since last month my employer has been acting weird and has been finding faults at everything that i do. last month they stopped 50% of my salary. On being asked he told me that my performance was not upto the mark and that he would release the rest once he sees my improvement. This has been highly unprofessional. No official mail was served for this from employer side.

After this i decided to resign from the company. Now that the notice period of a month is coming to an end, the employer is not ready to pay my notice period salary and the previous month's 50%. Please advice.

I am really depressed and lost due to this. It feels like al the work that was done by me was left un appreciated. I have heard of other employees who have been treated this way by the employer.

Please advice a coarse of action.

Your IT firm is most probably registered under the Shops & Establishment Act. It is mandatory to pay the salary within 7-10th of the next month. If such salary is not paid, then you demand the outstanding salary in writing (send through registered post) and even if they don't, then you have to approach the Referee under the S& E Act in order to recover the outstanding salary.

Hello Gentleman,

Acknowledge your concern and prima facie it is evident that employer is on fault but being a law expert or to advise you further may I request to upload or appraise with letter of appointment issued to you with terms & conditions etc.
