Alimony
« on: June 18, 2016, 11:46:36 PM »
I have filed for divorce with my husband and no where we are mutually fighting it out. I have demanded 30 lac lumsome which he is not agreeing for.
If the court decides a lesser amount that i dont agree upon what happens
How much time will the case take both parties do not co operate.
My husband is in the army and pays me 10k evety month. I work and earn 20k and his salary in hand is 55k.
I have also applied for interm amount.
I want to know how much time such a case take and if i dont agree what amount court decides what happens to the divorce

There is no time frame for divorce decree granted in a contested divorce, you may not even get it.

If the court grants less than the amount u ask for, than you have the option to appeal against that order.

Since you are earning and still getting 10k is already fantastic.

Best solution Is cone to a conclusion with your hubby and settle everything mutually.

In family matters court only directs ot for meditation rarely passes orders.

You will be hanging around in court for years.

What I understand is if parties don't agree the case will keep going on. If my husband feels 30lac is a big amount and does not agree this case will not be solved. The judge has no say will he give no final judgement to solve.

You are in wrong conception. If the parties to the suit are not able to compromise their dispute out of court then court will proceed the case in normal course and pass judgement on its merit. There is no way to continue the case years after years.

But I personally feel that the amount you have demanded is too much. You can revise it and get out of this mess
