i got married under christian marriage act 1872. the marriage is not solemnized in Church (Roman Catholic) till date. I have neither stayed together with my husband ever since the registration. since i was being physically abused at various occasions when we used to meet.I have lately come to know that he is having a kid from his previous relationship wherein he stayed with the girl for 3 years. i now want to file a divorce. kindly inform me the procedure and time taken.

Dear Ma'am,

You can file a petition on the grounds of cruelty under indian divorce act, which is applicable to the christians. It may take two to three years for completion or may be little less or more time.

You have not clearly mentioned about his previous relationship. Whether it was marital or just a relationship. If he is married then he has done crime by registering your marriage but if he got divorce then you have to file a petition for divorce for annulment of marriage as your marriage has not been consummated*

*[As you have not stayed together for a single night together under one roof ]
