Forced Marriage - legal advice...

Dear all,

I got married on 13/02/2014 in a Hindu temple as per Hindu customs. The marriage is unconsummated one due to the refusal & unwillingness of the bride. She says she agreed to the marriage just because of her parent's compulsion. She hasn't changed her stance in the past 2.5 years...She seeks divorce now. As of now, We are not living together as well. Can I go for annulment of the marriage?

Before marriage itself, I very openly asked the bride's father about the willingness of the bride for the marriage, as I got doubt about it. He blatantly lied about it. I strongly feel because of their idiotic deeds & drama, I am being punished unnecessarily...

Are there any way I can punish them legally...

Dear Sir,

You cannot file for annulment as its more than one year of marriage. If wife is ready then file for divorce on the grounds of  mutual consent. It may take maximum six months.

When your marriage happened in the temple and it is not been registered then you have to file a petition under Hindu Marriage Act and under same act, you have no ground for annulment of marriage. You have to simply file divorce case.

Dear Sir,

Even though the marriage took place in a temple as per the Hindu Customs, it was registered afterwards... But the marriage took place on 13/02/'14.

Can I go annulment or I have to settle with MCD???

Dear Sir,

you have to file for divorce on the grounds of mutual consent if wife is ready for divorce or else file on the grounds of cruelty against the wife. No grounds for annulment and it can only be filed within one year of marriage.

You have to go for mutual divorce.

Dear Sirs / Madams,

Can I seek compensation from the BRIDE side, as they have cheated me by suppressing the non-interest of the bride, even though I asked about it openly before the marriage itself due to my doubts...

She is a Private Bank Manager & Tax payee... But I am not a taxpayer due to my nature of my job... Is it possible for me to get COMPENSATION because I strongly feel that they have unnecessarily messed up my life...

Getting divorce is the best COMPENSATION you will get. So, dont expect what you don't deserve in the eye of law.
