My Uncle(Taya ji) sold his factory land (which he got in inheritance) to my mom in 1995-96. Registry and all documents are in name of my mom. In registry it is clearly mention by my uncle that "Me and any member of my family have not any concern to this land now". My dad and uncle were jointly operating a workshop of manufacturing cycle parts on same land (Firm Closed now). My uncle is no more now and his son is not ready to leave that land and asking for his share stating that my father was partner in firm. We ask him he was partner in firm not in land and firm is closed now. Land is in name of my mom. He is using that land for his own work (some kind of rubber part manufacturing). Please update what can we do? ::)

As I perceive he I not a tenant.

Hence he is a trespasser you should immediately get him evicted by police lodge a complaint in police station for the same.

Delay will hamper your chance in court.

Imemdiately file a criminal case against him for trespasser as well as file an eviction suit against him.

Thx advmisthi and adv.amarnath for your valuable reply. He is not a tenant. But Trespasser for sure. We showed photocopy of registry to them but they are not ready to listen, Stating that we took signature of my there dad (My taya ji) by cheating. Whats our chances to court  and how many approx time it will take ?

Adjudication is not a lottery. So question of 'chance' does not arise at all. If you have a good case then you will get order of eviction. No lawyer can tell you duration of case.... it varies from court to court and lawyer to lawyer.... In west Bengal, it takes 3 years
