insolvency petition in cheque bounce

Hi Expert,


Can you please advice, in cheque bounce case if accused file 'insolvency petition' and he shows he has no asset. Will he walk away easily from punishment ? Can complainant file 'Civil suit' for money recovery?

Dear Sir,

Insolvency petition is there to stop the recovery not the criminal act of your. Bouncing of cheque is criminal offence and there is punishment. It may not be of any help.

If he is of to opt for punishment if he dont have money to pay. Can complainant still file 'Civil Suit' for recovery of money.
