Hello,

I have DV and cyber crime cases pending on me.

Wife has filed divorce and it's at the stage of cross examination of her. She is planning to get the divorce and keep the criminal cases hanging on me.

Can I put Stay order on divorce petition, According to Civil Procedure Code 10.

She did not marry herself she married you , another person.
she wanting a divorce does not mean she will get it without your consent.

so relax. she is wasting her time in useless pursuit.

relax, let her have her experience finally she has to come for mediation, there you demand all cases be withdrawn only than will you give mutual divorce consent.

But, my divorce is cross examination stage.

What shall we tell the judge during the next date, why don't we don't want to cross examine her?

Dear Vishal,

There is no such process that during the pendency of the criminal case, there can be any stay granted on the divorce. Please contest the cases on merits and complete the formalities of the divorce case. If you avoid then court may proceed ex-parts or close your right to cross examination, which may not go in your favour. However, if you contest the cases then chances of getting the divorce dismissed is also there.
