Undisclosed marriage and consequences
« on: August 07, 2016, 02:48:40 AM »
Hi, so a frnd of mine underwent a tatkaal marriage in feb 2015 with his gf and the marriage has been successfully kept a secret till now frm both the families, but now they both have developed differences and wish to get it annulled equally secretly, the girl was 20 and the boy was 24 at that time. Including families now might mean a health hazard as the girl's father is a heart patient. Advise on annulment and what would be the consequences if both decide to keep it a secret for the rest of their lives and part ways? Pls talk about the effects on govt employment and passports and immigration if they decide to do the latter. Are citizens records pulled out during pre employment verification pf govt jobs?

Dear Mr. Singh,

Both can file for divorce on the grounds of mutual consent and take divorce. the divorce may take six months and both have to appear before the court twice. Once there is a marriage  they have to take divorce from the court. Its up to them whether they wish to disclose the same to other or not. In employment these details are never considered for giving a job or taken out.

Dear Mr.Bansal, thank you for the concise and practical reply.
So it's entirely possible for both of them to just abandon the relationship and act as if nothing happened, since mutual consent divorce requires at least the presence of one of the parents from the girl's side to be granted.
If both are ready to simply abandon their claims as the other one's spouse, is it a feasible option?

Dear Sir,

In mutual consent divorce presence of any side parents are not required at all. Court may not insist of appearance of the parents of the girl or boy. Even if insist, you may simply refuse. You have understand that married is a legal marriage and cannot be abandoned like this. In future it may lead to lot of complications as you never know the life and twist of the life.

Only way out is the take mutual consent divorce that may take six months and two appearance before the court.

for getting divorce through mutual consent the presence of both the spouses only is necessary during the time of presenting petition, first and second motion.you both can also hide the previous marriage but even the family members (blood relation) of the persons whom you marry can file cases of bigamy if they come to know that you had married them without dissolving the previous marriage
