I would like to ask I want to take divorce from my wife but I am living abrod,past 2 years I didn't visit India and not possible visit soon, can my wife file a case against me if yes what kind off, we married 12 year before,we have 8 year son I am sending money some time for her ?

If you dont live together file mutual consent divorce.

If you are on good terms.

Otherwise, she can file all possible cases against you.

Hello what is mutual consent divorce,
? If I am not visiting India 1 more year or going after 5 years and she file case against me what will happen ,
? Can I give someone attorney of power ,

Dear Sir,

If your wife is ready then you may take divorce on the grounds of mutual consent. It means both are ready for divorce and a joint petition filed before the court. Yes, your wife can file for maintenance and other cases despite the fact that you are not in India. For contesting those cases, you may execute POA to your parents or bother or sister.

If wife is not ready for divorce then you may also file for divorce on the grounds of cruelty or any other grounds as per the facts of the case.

Yes, your wife has right to take an action against you. You can get divorce with mutual consent.

if I pay monthly amount for my kids and wife,
in this situation what case she will file against me?

payment of maintenance on your own may not preclude the wife legal rights not to file the cases against you.
