Hello lawyers,
I filed for divorce on mutual grounds but ex husband withdrew it just one week before it was finalized as he stated that he does not believe in divorce. I want to know my options for divorce on other ways. If after we have been separated for two years, can I file a divorce and what kind of suit? I was spiritually abused, mentally tortured & sexually abused; I know he cheated but I have no proof to present to the court. He is a con artist who has scammed many people including my family. I just want my legal freedom, I don't want anything from him. Additionally can it be done as soon as possible? There are no children and we were married in 2010 (christian marriage act) & got the marriage registered under Special Marriage Act. We belong to ST category from Shillong, Meghalaya.
I went to a lawyer (well known here) but was cheated by him as he is delaying the case so I told him to forget it.
I have lost faith in the system here.
Please help.

Under Christian marriage act divorce contested divorce can be filed on the grounds of adultery only.

Now in contested divorce there cannot be any time frame. And more over it I the court's discretionary to grant divorce or not.

But you can convince your husband for mutual divorce.

As you said you have been mentally torchered, file dv and 498a against him.

Dear Ma'am,

As you have performed your marriage under special marriage act, in such case you can file a divorce on the grounds of cruelty and desertion (two year separation) against the husband in the district court (family court).

For christians, Indian divorce Act is applicable and the provisions of cruelty and desertion is given there but for you only special marriage act is applicable.
