Legal status of marriage after conversion
« on: September 07, 2016, 05:59:53 AM »
Two individuals, a man and a woman belonging to religion X, married under the marriage act of religion X. After a few years, one of them converted to religion Y. What is the legal status of marriage after conversion? Do they need to remarry legally under Special Marriages act? If not, how does court determine aspects like divorce, alimonyafter divorce, division of property etc?

Dear Sir,

Change of religion will not change the relation. You will remain married and cannot marry just because the other religion permits you to perform more than one marriage. You don't have to perform any other form of marriage once already married. Though it certainly gives a ground to other spouse to file for divorce in case husband or wife change their relation after marriage. But no right to the person who has changed the religion.

Marriage, divorce and any other legal issues will be settled as per the law under which the parties got married for the first time before change of religion.
