We have 1 property in slum area, because of High court order 140/2006 to secure the TANSA PIPE LINE- WATER PIPE LINE
BMC issued at notices to slum dwellers to submit documents and decided their eligibility.
we have a 2 PROPERTIES :
PROPERTY 1 :
in the name of My Father (RAHUL)
Rahul purchased the Hut in 1994, AND Transferred this property to his SON i.e. SANTOSH, he have a papers like Electricity meter from 1994 to till date, Election card, Bank passbook, Ration Card, name in electroll etc.
he submitted the papers to BMC for alternate accomodation on receipt of notice from BMC.
On FIRST HEARING - we attented explained them our above papers very well, AND they QUALIFIED the room, we taken Keys of that ROOM plus Possession of that room
in the name of my MOM
Purchased from Sanju Jadhav in 1993.
Papers we have : A SEPRATE ELECTRICITY Meter From 1999 to till date, Bank passbooks, SEPRATE Ration CARD, name in electroll etc.
We submitted papers, and on the very first reply of BMC
we get QUALIFIED to get alternate accommodation in 2009 Itself
But, In 2013 we got 1 more notice from BMC, regarding : "DISQUALIFICATION"
THREE REASONS GIVEN BY THEM :-
your SON's name is in your Ration Card which means you were residing together which constitutes one family, hence, as a head of family we are allotting Alternate accommodation to your Husband, and as your husband given rights of property by his POA, your Step-Son is Eligible to get alternate accommodation not you, Hence SANTOSH will get the room
As we have a SEPRATE DOCUMENTS FOR BOTH THE ROOMS, Still BMC not giving another accomodation to MY MOM - Even though Govt resolution dated 16-05-2015 allows to pass a huts on the basis of 2000's papers, There is a one clause in it regarding declartion to be given by slum dwellers that, " He or his spouse or His 18 year below child do not have a another hut in the same BMC Area. "
ON this clause only i am fearing to fight in court.
