Property issue amoung family members
« on: September 29, 2016, 01:37:14 PM »
My father purchased a house. The major part of the consideration paid by my uncle (mom's brother). At the time there is no written agreement between them.

He (uncle) lend the money without interest and nothing documented on the trust and relationship believes . Everything is in oral. that house reg. in my father's name. Now there is a bad situation with my father and uncle relationship.

He (uncle) feels my father may reg. the property in any other person name. how to prevent my father to sale or pledge the property.

And my uncle want to reg that property in my mother's name.

plz ans me from my uncle point of view (lendor).

When property has been registered in your father's name then there is no option cancel it. Even Benami transaction act will not support your case. Only option is your uncle has i.e. if he lend money to your father vide cheque then he has hope to get it back with interest.
