I am currently residing in USA and planning to get married in India in thane (Maharashtra) court on Nov 21, 2016. My would be wife is currently in India and I am coming to India in November.

As per the procedure, we need to file a Notice of Intended Marriage to the Marriage Registrar before 30 days of intended marriage date.

My questions are:
Is it mandatory for both the parties to be physically available when Notice of intended Marriage is filed?
Can i get my marriage certificate or copy of the same on the same day I am getting married?

Dear Sir,

Please tell your would be wife to find out from the concerned registrar of marriage office as sometime they give some exemption in some cases.

But the application and affidavits has to be signed by you and may be deposited by your would be wife.

Please tell her to find out.

Ans:Yes. Both parties have to sign in the Registrar's Book

Can i get my marriage certificate or copy of the same on the same day I am getting married?
Ans: No. It would be intend marriage. After registration of marriage then you will get Marriage Certificate on the same day

Have come across a judgment by Kerla High Court, where submission of application by post was allowed but waiver of 30 days notice period was not allowed. Don't know how much that will be any help to you as its pure discretion of the registrar of marriage. Hence please tell your would be wife to visit and find out first. Your signature in the register of marriage is required at the time of marriage and not at the time of filing of the application. I must have don't more than 100 of marriage, there is no signature is needed at the time of filing of the application, its only submissions of the application.
