Despite truck challan filled permit cancelled
« on: November 03, 2016, 02:10:16 PM »
My truck was challaned on 9/4/2016 for cartying exess load of 9100 kg.Against the charge I submitted 19000 rupee fine as ordered by the respective court. After 4-5 months, I received a notice by the transport department : STA branch informing that they have suspended the permit of the aforesaid vehicle for 3 months and ordered me to get my vehicle parked in inspection unit, burari. Please advice me that when I have already paid the penalty to the court then why am I being punished again by the transport department STA branch.

Dear Sir,

You have admitted the guilt instead of contesting case. Thus paying fine is no excuse to get concession in other consequent punishments like suspension of license. The remedy is to approach High Court and seek relaxation of consequent punishment.

Section 210 in The Motor Vehicles Act, 1988
210. Courts to send intimation about conviction.—Every Court by which any person holding a driving licence is convicted of an offence under this Act or of an offence in the commission of which a motor vehicle was used, shall send intimation to—
(a) the licensing authority which issued the driving licence, and
(b) the licensing authority by whom the licence was last renewed, and every such intimation shall state the name and address of the holder of the licence, the licence number, the date of issue and renewal of the same, the nature of the offence, the punishment awarded for the same and such other particulars as may be prescribed.
