Can a lawyer leave mid-case?
« on: November 22, 2016, 04:47:21 AM »
I have a divorce case filed in Mumbai. It has been a tough time for me since the respondent lawyer is prolonging the case using various deceptive tactics. My lawyer realises what the respondent lawyer is doing but cannot do much about it. I ask him questions on his plan of action each time there is a court date. However, he just threatens me saying that he will quit the case and I will have to find another lawyer every time I ask him questions. Can the lawyer leave a case mid-way like this without my consent? I agree that I am going through a bad period and get visibly frustrated with the lawyer at times.

Dear Sir,

As you can remove a lawyer anytime from a case. in the same manner the lawyer can also remove himself from the case anytime.

If a lawyer has received professional fee and withdrawn himself from the case its a gross negligence and he cannot do that whimsically. If he wants to retire for his personal reason then you have nothing to say about his decision. In case of professional fee above said principle will be applicable strictly.
