Gift Deed Fraud
« on: December 06, 2016, 02:19:34 PM »
The 4 storey property is in my mothers name. My mother, My elder brother, his wife and his little daughter stays together on the ground floor. Recently I came to no that my brother has made the registry of 1st floor, 3rd floor and terrace under his name by fooling my mother to sign on it by telling her that there is some new law related to property and she need to sign it, my mother cannot read or understand English.
My brother had earlier made a will which stated that 4 storey property belongs to our mother and after her demise it will be distributed equally, but the will does not say that who will get what floors.

My question is that I do not like the floors registry my brother made, I wasn't informed. can I challenge it in the court ?

Regards
SK

First of all hpow are you sure that your brother has tricked your mother and got this division of property done.
if your mother is willing to make a statement, in police the entire thing can be restored back.

Hello advuma,
Thanks for replying, I had the feeling that something is going on, I asked my mother about it and she said that she was told to sign on pretex of some law change in property deed.
I have some questions: -
1- how police can restore back, you mean to say I need to file a case in court?
2- is there a time frame by which I need to file a case in court ?

Regards
SK

Above advice is absolutely rubbish and not at all has legal stands. Deed of Gift cannot be challenged save and except by the DONOR and same is very tough to declare the Deed of Gift null and void or cancellation of same. It is to be keep in mind that Deed of Gift are compulsory registered documents and at the time of registration, she has to present before Registrar and several photographs and finger print are being taken by Registrar's Office. So, fraud cannot happen so easily until some contrary proves with cogent evidence
