Marrying a foreigner in India : details

Hi,

I would like to know the procedure and documents required for marrying a foreigner in India if she is divorced. The documents are in Italian and the divorce decree, judgment is in Italian too.

Please clarify the following related to Special marriage act :

1. Will she be required to be present while submitting intent of marriage application? If not then, only her signatures can work since she will be outside India?
2. I know that the documents need to be translated to English. But how can it be done officially(procedure)? Is there anything to get from embassy also like a letter of no impediment(in case of UK citizen).
3. If she converts to hindu, is there any alternative or easier process?

Your to be wife has to obtain a bachelorship certificate.
And has to be present with the divorce decree and bachelorship certificate at the time of filing for marriage.

And also should stay a minimum of 30days in India.
This is the main requirement no alternative.

Ans: No, she must present at the time of application and registration.

2. I know that the documents need to be translated to English. But how can it be done officially(procedure)? Is there anything to get from embassy also like a letter of no impediment(in case of UK citizen).
Ans: Registrar shall not ask about same neither you are required to say about her past. When she is being divorced from Italian Court then there is no question of bigamy nor anyone has objection.

3. If she converts to hindu, is there any alternative or easier process?
Ans: Conversion to hindu is not a legal question. Ask some Hindu Pundits.

- you need certified copies of the judgment and decree and translated from official translated from the italian embassy on his letter head. The same will be submitted along with the marriage application form.

--- She needs to be there before registrar of marriage at the time of filing of the application as well as at the time of the marriage. Moreover she needs to obtain NOC from her concerned embassy for getting married in India.

2. I know that the documents need to be translated to English. But how can it be done officially(procedure)? Is there anything to get from embassy also like a letter of no impediment(in case of UK citizen).
-- Please check the embassy website or call them, you will find lot of official translator associated with them. However these translator are very expensive.

3. If she converts to hindu, is there any alternative or easier process?

-- no need to convert her to hindu. Please process the aforesaid documents and file an application under special marriage act. The entire process may not take more than 35 days after submitting the application.
