Injuction, please help
« on: December 16, 2016, 10:56:53 PM »
Hi, I couldn't figure out the right section for my question. This is a question that I'm asking to understand for a screenplay that I'm working on. So, I really hope one of you will help me.

I run a college (in the story) and a third party is taking the side of a dismissed student and is harassing me again and again, speaking for the dismissed student which was done as a disciplinary measure for grave misdemeanor on college campus. I have genuine reasons to feel harassed by this person.

Now, can I get an injunction from the court without him knowing which prevents him from entering the college campus? Which I can later show him and make him understand? Also can I get an injunction within a week's time? Which court is the point of first contact for this?

Please help me understand this.

Dear Sir,

You may file a suit for injunction along with application Under Order 39 Rule 1 & 2 seeking temporary ex-parte injunction. I don't know whether you may get the injunction within a week or not but this is the provision for filing the case  in the court. The suit will be filed in the district court.

Thank you sir. That was helpful. Could you please also tell me if this injunction will pretty much work like a restraining order preventing a person from entering a premises?

Also, what would be the complete legal name of such an injunction?

Also, dear Jai,

adding one more question to my previous questions. If the person violates the injunction, can she be charged with criminal offence?

Thank you in advance.

No criminal offence. It can be maximum contempt of court in civil case.
