Ancestral Land and Revoking a Will
« on: January 08, 2017, 01:43:58 PM »
My Grandad inherited land  from his father in Himachal Pradesh. He made a WILL in 1974 stating my Father and  my uncle (Father's Brother) as  beneficiaries  upon his death. However, my father passed away before my Grandfather in 1996 and my Grandfather made a new WILL stating My uncle and my brother as beneficiaries, leaving daughters( my sister , myself ) and my mother out of it.  As my uncle manages/controls Land in Himachal, when I asked him for our share, he dismissed saying Daughter and widows are not entitled to any property.  As it was my Forefather land, I would like to revoke Grandfather's  latest Will. Even though my Brother is willing to give me some land as Gift Deed, it will still cost me fortune in stamp duty and registration fees. I am not sure about expenses and timescale involved to revoke the second Will.  Please help with your suggestions and advice.

Only the person making a WILL can revoke it.
you cannot revoke someone elses WILL.

Thanks for your reply. So can I challenge/contest the Will for my share of land. If so, what is the procedure, fees and time scale involved?
Thanks
