1. I am a pro se litigant. I applied for amendment of WS and the judge dismissed the application stating it is not in proper format. I cannot find the format on online CPC download. Can any body help me with the format for amendment of ws as per order 6 rule 17 of CPC.

2. My brother has put a suit against me regarding the mothers properties in senior court as well as junior court. I have raised all all properties in sr. court in my ws and I am demanding dismissal of jr. court case on sec. 11 of cpc resjudicata on grounds that the issue is ongoing in sr. court and not stay of suit as per sec 10 of cpc. I am contending that sec 11 is relevant for both ongoing issues and decided issues in former sr. court suit. Can any body help me to give me any citation of AIR, SC, etc. or any section of cpc aidind my contentions.

you go with the facts to the typist in the court area there you will find many of them ask him to type as par order 6 rule 17.

he will do it.

by the way how did it cross the counter and land in the judges table when it is not in proper format????

Mine is a small district court. There are no typists outside the court. I depend on online downloads. Most formats are there in my downloaded CPC 1908 pdf but, WS amendment format is not there. I had made the WS amendment in the form same as former WS but included only the changed part and submitted with an affidavit. Former judge was supportive. This new judge is not supportive for self representing litigants. Hence I want to confirm whether I was really wrong.

It is not possible for us to send a format of petition. It's better you can buy a book named as Plaint by AB Majumdar. It is a good book which will guide you.

Thank you Amarnath Sir, I will try to get the book but it will take time. I'm in a remote village of Karnataka. I can contact you if you let me know the free time of the day. In my WS ammenment was in a following arrangement.

Name of Court
Case no
Name of plaintiff Vs Name of Defendant.
WS ammendment as per section ------
Amended matter : (I included only the part of the amended matter giving reference to the point of the main WS. I am doubting that  I should have typed the full matter of original WS along with the amended portion.)
Signatures
Veryfication
Then a seperate application and an affidavit was also given to the Judge.


Any problem can be descerned from the above?
