Property dispute
« on: February 08, 2017, 06:04:00 AM »
Hello,

I am from Andhra Pradesh. My grandfather (father's father) has 2 sons and 2 daughters and all are married before 1985. I am the son of demised elder son of my grand father. Recently in one of the house dispute, the court has passed an order to share the house equally amongst 2 sons and 2 daughters.

Inturn, I have given my share to my aunt (father's sister) for a very less amount but it the property is not yet registered.

Can I go back and file a case against my aunt (father's sister) ?
If my aunt tries to sell her share and my share to someone else without informing me, is there any chance of getting some money ?

Thanks,

If you did not execute a registered deed in favour of your aunt then you can file a suit for Partition and Injunction in Civil Court claiming your share.

As you have said that property has not been registered then dishonestly you can claim the property or ask for further money for registration. You have to take injunction under this situation

I just saw that, in 2010 I have committed and signed on 50Rs. stamp paper that I have received the amount from my aunt and whenever she needs, I am ok to get the property registered on her name only.

Kindly let me know if there are there any implications involved here.
