House Dispute
« on: February 11, 2017, 04:31:32 AM »
My father bought a house during the 1980s when I was a minor. After I turned major, it was transferred to my name. During this period, we had our relative stay there. Since, they were relatives, there was never any type of agreement signed for this. As now I have some problem (health issue [undergone heart surgery] and physically disabled since birth), I requested them to vacate the house. But, they demand money from me to vacate or they want my mother's land in their name against vacating this house.
Please let me know if any way out of this:
1. Is there a way to get this sorted out legally?
2. Can I go ahead legally?
3. If yes, what are the points available in Indian Law.
4. Checking if there is a provision to file this case on a fast track considering my disabilities & medical issues. (I want this sorted at the earliest.)
5. General belief the case takes ages in the Indian court. Request to inform what time it take for such cases.

Please advice.
Thanks

1. Is there a way to get this sorted out legally?
Ans: I would suggest that don't indulge this type of illegal demand by your relatives. They are bound to vacate it once legal notice is being served upon them. They are in permissive possession.

2. Can I go ahead legally?
Ans: yes, absolutely

3. If yes, what are the points available in Indian Law.
Ans: You have go for consultation in details with me.

4. Checking if there is a provision to file this case on a fast track considering my disabilities & medical issues. (I want this sorted at the earliest.)
Ans: There is no law for your disabilities but court should consider your position on sympathy ground.

5. General belief the case takes ages in the Indian court. Request to inform what time it take for such cases.
Ans: It varies from court to court as well as conduct of both side lawyers. I did several same cases and it took 2 to 3 years maximum if defendant contest the same otherwise it takes 1 year
