Doubts regarding Mutual Divorce
« on: March 10, 2017, 11:13:54 AM »
Hello,
I am the Husband,
Me and my wife are not compatible in our way of life after marriage(2yrs) and decided to go for a Divorce by mutual consent suggested by my wife.
We have a kid(minor) and currently staying separate.

My wife informed me that I have to return all the things that have given by them at the time of marriage. and I have to pay alimony and maintenance. She is employed and earning more than me.
We are yet to decide about all the conditions for the Mutual Divorce.

I myself have decided that I will return all the assets(Stridhan),
All the Jewelries/Gifts that was received from both of our relatives are already in her possession. I only have 2 - 3 movable assets in my home town, which was given by them as a part of marriage customs. (Like bed, dinning table etc.)

But I have a suspicion that she is going to demand some unusual amount and will also add up things/money which were not given by them as a part of Stridhan, just to put me and my family in more trouble(She has already done that before).

She also threatened me that If I dont agree to the her conditions for mutual divorce then she will be filling a case against me, not sure which type of case.

Any suggestions that how I should proceed with this Mutual divorce thing is greatly appreciated.

First, it is not possible to tell you all the procedures and tactics to handle your situation in open forum and under free online consultation. You have to contact me over my email given below.

It is very good to exchange all articles and ornaments between you and your wife but question of stridhan arise only on that situation when wife is "stri". in your situation she is no more willing to be your Stri (wife) so question of stridhan is baseless.

Asking for unusual demand is totally depends on you how much you agree else turn down the proposal of mutual consent divorce and let it be. Alternatively you can file divorce petition against her
