Regarding termination of tenancy
« on: April 12, 2017, 03:56:34 AM »
Hello respected sir,I am doing a business in a market of 20 shops in Chennai. All the 20 shopkeepers in the market paying rent regularly to the landlord. The landlord filed petition in the court of small causes against all the 20 dealers to vacate the portion on the ground that dealers deny title of landlord and not ready to do Agreement, in March 2015.Now the landlord want to settle the matter out of court and even I volunteerily vacated the shop and handed over the keys to him.But the thing is he wants me to give a written statement that I had volunteerily vacated .On the part of both the parties which one will be eligible to give a written statement, whether it will be me or the landlord .Does the landlord is required to give me in written that he had withdrawn the case and there is no due of rent from the tenant???

In the petition filed, he disclosed the honorable court that I am paying a rent  of Rs.11470/-p.m. where as I have paid Rs.4000/-p.m. for which he issued receipts of Rs.4000/-  till March 2017.
Please suggest the required. Thanks & regards.

It is necessary to withdraw the case against you otherwise you shall be liable to pay arrears of rent if any with interest.

Hi regarded sir,I am doing a business in a market of 20 shops in Chennai. All the 20 retailers in the market paying rent frequently to the proprietor. The landowner documented request of in the court of little causes against all the 20 merchants to clear the part on the ground that merchants preclude title from securing proprietor and not prepared to do Agreement, in March 2015.Now the landowner need to settle the issue out of court and even I volunteerily emptied the shop and given over the keys to him.But the thing is he needs me to give a composed explanation that I had volunteerily abandoned .
