Appointment letter served after months,no salary slip

Hello

I joined an NGO on OCT 25, 2016.. I was told on phone that I will get appointment letter on day of joining.

My first salary was paid on around NOV 10, 2016

Appointment letter was served on DEC 8, 2016
(At this point they have Around 70K+ of my salary)

Second salary was paid on DEC 15, 2016

In the appointment letter they introduced 3 months notice period in the appointment letter without any consultation.

At this point they had 70K+ amount with them and I did not had any legal document to prove my employment with them so I kept quite on this as there was every chance of loosing all money

Now, because of my health problems I can not travel and go to office. and they are demanding 3 month notice period and damages to the work.

I have offered them to work from home but they say.. it is not their policy. No such policy is mentioned in the appointment letter. It was never discussed. I am their first and only employee in this division. It is a big organization that has 150 schools.

For the last 1 month I am not going to office and also haven't resigned.

They haven't sent me Form 16 and also not responded to my email about this.

Also, not given my previous months salary.

Till date they haven't given me any salary slip even after asking for it multiple times.

They served me this appointment letter via email and after app 10 days of this appointment letter... they released my prev month salary.

Means always they had sufficient amount was with them

QUESTIONS:
1) Is appointment letter valid?
2) What are the possibilities?
3) What is the proper way forward?
4) What if I resign?

Appointment letter is valid even if it is given to you at a later stage. Even in absence of appointment letter, employer employee relationship can be established through other documents.

Regarding your health issues, have you submitted any medical certificate to you company? Is there is medical certificate at all stating that you are medically unfit to go to office?

Company has rightly demanded the notice pay as mentioned in your appointment letter unless and until you can medically prove that you are currently unfit for the work.
