How to file a partition suite
« on: May 08, 2017, 03:27:11 AM »
Sir,
I Sai Subrahmanyam, My father and his friend bought a land in 1980 registered together, my father friend was died long ago, now his sons are telling the entire land is belongs to them,
But I have a registered document for the land registration, even I have taken EC for that land, which clearly mentioned my father name and his friend name and there no transactions on that land since 1980.  Recently they have given some of the land given for Restaurant, without my notice.

1. How to get my land share legally.
2. What type action, I can take against that restaurant owner.
3. How to put a Trespassing sign board in that land, any permission is require from the court. To avoid future transactions.
4. is there any procedure to given the public notice in the local newspapers regarding the land ownership?

1. How to get my land share legally.
Ans: File Partition Suit

2. What type action, I can take against that restaurant owner.
Ans: Nothing right now... later once the property get partitioned you can either claim for rents or eviction from your portion. Now you can also claim half rent from the restaurant owner.

3. How to put a Trespassing sign board in that land, any permission is require from the court. To avoid future transactions.
Ans: meaningless question until you file a partition suit.

4. is there any procedure to given the public notice in the local newspapers regarding the land ownership?
Ans: meaningless unti you file a partition suit
