Inter Faith Marriage under Special Marriage Act
« on: May 08, 2017, 06:10:24 AM »
Hello All,

First of all, I am thanking you all lawyers of this forum by heart who is helping us truly for Indian Legal Lows.
Now my concern is, I am Hindu and I wish to marry with a Muslim Girl, We love each other so much.
Problem is we can not marry same place, district we are leaving due to risk of that our parents will got informed.
Since our parents knew about us we do not want to take risk of exposal of court marriage application due to it takes 30 days notice out side marriage registrar office,
We know special marriage act for interfaith marriage and that is the only way to marry different regional persons.
So we have decided to marry from other district, other issue is girl's parents has taken all her documents after knowing about as.
After carefully study of special marriage act we have came to know few conditions for marry other district and documents required.

1). To marry in other district - One of us must be living in the district for minimum of 30 days.
is it ok one of us who is staying in other district so we can marry in their district ?

2). Regarding her documents my question is,

Though she does not have any documents, main birth proof,
She can make affidavit of birth that she is so and so age.
And this affidavit we can be submitted as a proof of birth ??
or
Can Adhar card be submitted as proof of birth in Special Marriage Application ??

3). I have also read that marriage registrar can forward intended marriage notice copy to near police station ?
is this true ?
and if yes, does he forward intended marriage notice copy to same district address we applied for?

Looking forward for your true guidance.

Thanking You in advance,

Regards,
Sahil

Ans: Yes, but documentary proof is required of staying more than 30 days at a stretch.

Ans: Adhaar Card or Voter Card will be for her residential proof. She has to produce either Class 10 Standard Admit Card or Birth Certificate. No affidavit.

3). I have also read that marriage registrar can forward intended marriage notice copy to near police station ?
is this true ?
and if yes, does he forward intended marriage notice copy to same district address we applied for?
Ans: No, Marriage Registrar should not send notice to local police station.
