Father torturing for property after death of mom
« on: May 26, 2017, 09:04:09 PM »
My mother died 2 years ago without doing a will, our house was registered on her name. We are two brothers with our kids and wives.

My father wanted to have our house and torture our wives, kids and us  daily. So we have decided to sell house as per the manual agreement my father take 50% of the amount and give us 25% each to both of us.

And he didnt give us cash and force us to buy house with those 25% money and added his name in the registered documents too.

We bought house for 10 lacs 30 thousands, I have given cheque of 5,30,000 and he gave cheque of 5 lacs.

We dont have written proof that he has taken 50% of the amount from sold original house. It was decided with support of our uncle (brothers of my mom).
Now my father again started torturing us saying that he need his share in our new house.

I just want to know what are legal option in this case.

he is toruturing our wives too. So can they file seperate case for that too?

see a senior citizen also has special rights, just don't jump into a legal battle.

you should first try PRE-LITIGATION MEDIATION in the High court, that could solve the problem. which city are you from.

Do son and daughter in law have rights in India? Father keeps fighting every day and break vessels and electronics items at home frequently. Should I record in camera and show it as mental harrasment?

Simple file a complaint before police station through your wife about his torture without mentioning about property demand and the complaint will be treated as FIR under 498A IPC. Hopefully he will get good lesson in this senior age.

Mind it, your father has right to claim his half share but above advice is only way to tight him legally for his torture
