Leave & Licence Agreement Term Regarding

I had given my flat in Pune on L&L agreement (after proper registration) to a tenant for four years from Dec 2013 till Nov 2017 - My tenant now is interested in renewing for a final four year term and going in for a fresh L&L agreement (and subsequent registration). The concern I have is would this be a problem for me later in case I ask him to vacate the flat in 2021..would he claim any rights to my flat for staying in the flat for 8 continuous years??

Kindly advice me urgently on this legal aspect and what I need to do to protect my rights on the said apartment.  Thanks

Without seeing the terms and condition of Agreement, it is tough to tell you as License and tenancy has very thin difference while in former not exclusive rights of possession are given and in later exclusive rights are been given. It is tough for a layman to understand this difference but when disputes arise and come before court, then question of determination comes. Anyway.....

Without making it further complicated, you can give leave and license but dont use the term renewal. Execute the Agreement as if it is new. There are several points/ terms and conditions are to be added in the agreement which will absolutely deem as Leave and License.
