PRIVATE NOTICE AND EX-PARTE DIVORCE
« on: October 26, 2017, 04:55:29 AM »
Me and my husband are not living together for more than 4 years now due to abuses, fraud etc. I have filed for divorce this year and sent the notice to his address in his native. But he has not received the notice for more than 6 months and the court asked to send a private notice 3 months back. My lawyer is not explaining the process clearly. What is a private notice and how long will this drag on ? I searched various forums and learnt that I can get ex-parte decree if he does not receive the notice and simply delays the process. What will be the next steps. It is now 10 months since I filed the petition.

If you could get him to accept the summons and he does not appear in court, then you could get ex-parte divorce quickly.

Esle if he does not receive summons than to get ex parte divorce will take couple of years more

I think the judge meant that you take the dasti notice and send on your own referring as private notice. Or try to serve on your husband on your own. Let your lawyer do the task.
