Share of house property
« on: December 18, 2017, 08:40:10 PM »
Dear Sir,

The house property in Calcutta belongs to my Grand parent A, who died living behind four sons B, C, D, E.  B died first then C then D and then E died.  The wifes of B, C and E died.
B has one son B1 and one daughter B2.
C did not have any issue.
D was unmarried.
E has two sons E1 and E2 and one daughter E3.

How the property will be shared among B1, B2, E1, E2 and E3.

Thanks in advance.

Yours

S K Sadhukhan

Dear Sir,

If you are looking for a family partition deed out of mutual understanding then you may sit with a local lawyer, who will help in settling the division of property as per Hindu Succession Law. Or else if there is not mutual understanding to divide the property, in such circumstances, you may file a suit for partition. The person who is expired without any legal heir, their shares will be shared by other surviving legal heirs in class 2 as per Succession Act.
