Taking over a property after death of occupant
« on: January 18, 2018, 05:51:25 PM »
My uncle used to live in a portion of our ancestral house on which there is a dispute however I am the owner of that said portion and my uncle had only living rights provided by my grandparents to him in the property. Now my uncle has died but the dispute is ongoing as other relatives have filed a claim on the same property, however if I am the owner on paper of that property then can I start using that portion where my uncle lived or do I need to keep it locked until the dispute is resolved? Some of my relatives are scaring me and saying that i cannot enter that portion until the court resolves the dispute and the keys for that portion are deposited in court, is this correct or false?

Dear Sir,

You can use the property till the time dispute is resolved. I hope there is not stay from the court for using the property.

Dear friend,

It is your property and if the keys are with you then you can enter and use it, provided they not order of status on the property. If any status or injunction order is there then try to get vacated and enter into possession of the property.
