Succession certificate
« on: May 04, 2018, 09:01:53 PM »
An Indian hindu widow died intestate leaving behind a daughter and a son who are both US citizens living there for long years. The widow had a demat account in an Indian bank covering a large number of equity shares at the time of her death. This demat account is tied to a savings bank account in the same bank in her name without any jt holder and nominee.
Under the above scenario are the siblings required to apply for succession certificates to the concerned District Judge jointly or separately?

Dear Sir,

Succession Petition has to be filed jointly before the district court. However, before filing the succession certificate, they may approach the court jointly for transferring the account in their name by showing the death certificate.

As per Banking regulations, there is a claim settlement form, which can be filed by them before the bank jointly for entering their names in place of their mother.
