Residential plot grabbing issue
« on: May 10, 2018, 10:44:55 AM »
Hi Everyone,
I am currently living in Delhi, My home town is in Bhimtal, Uttarakhand. I have one plot there about 2700 sq. ft. which was purchased by my father in year 2001-2002. At that time the plot was purchased in Rs 80000 and registry was done in name of my father. He had done boundary wall over there also. In year 2005 unfortunately my father was passed away and the plot was transferred to my mother's name. After 2-3 years she executed the "Dakhil-Kharij" of the plot. Now  in 2018 April, the person from whom we purchased the plot is trying to grab it. He trespassed into the plot and built one green house tent. We immediately went to see the plot and asked the person whats the matter and asked him to remove it. But He is telling us a story that when your father purchased the plot there was a deal that plot's cost was Rs 150000, and your father was passed away and now we want our land back and we will give you 80000 + interest whatever it is. This is seriously insane. Also they threaten us that if you go to court we will physically harm you or your relatives. My mother is having the papers of land and she is scared of them and not giving papers to me for any legal action to take. The property is legally in the name of my mother and the accused is forcefully grabbing the property.  What shall I do, pls suggest me some effective procedures so that I can protect my land and get such evils to learn lesson.

Dear Sir,

As if now please file a criminal complaint for trespassing against the last landowner who sold the property. If nothing happens then file a civil suit for possession and injunction. Everything he is saying is Oral, and the same has no value in the eyes of law. Property is already transferred in the name of your father then mother (now), she is the absolute owner. This person won't be able to do anything except troubling you.
