“Evidence handed over to Malkhana.”
Instead, record relevant particulars such as:
- date and exact time of transfer;
- exhibit number;
- description of the exhibit;

- exhibit numbers;
- condition and identification of seals;

The investigating agency should preserve the laboratory’s acknowledgement of receipt and, where recorded, the condition of the package and seals upon arrival.
Any discrepancy—such as a broken, damaged, or unidentified seal—should be documented and appropriately investigated rather than ignored.
Biological Evidence: Preservation and Temperature Control
Biological evidence—including blood, semen, saliva, tissue, and other biological material—is particularly vulnerable to degradation, microbial growth, and contamination.
Preservation requirements should therefore be determined according to the type of specimen, the applicable forensic protocol, and the receiving laboratory’s instructions.
Air-Dry Wet Biological Evidence
Where appropriate, blood- or body-fluid-stained clothing and other wet biological exhibits should be air-dried in a clean, protected environment before packaging.
Wet biological material sealed in an unsuitable container can retain moisture and encourage microbial growth, potentially compromising the evidentiary material.
Appropriate Storage
Biological specimens should be stored and transported under the temperature and environmental conditions specified for that particular specimen and applicable forensic protocol.
It is therefore unsafe to adopt a universal rule that every biological exhibit must simply be placed on ice or refrigerated. Some specimens require refrigeration, some require freezing, and others should be maintained under controlled dry conditions.

Indian courts have consistently held that an unbroken chain of custody is a mandatory requirement for sustaining a conviction based on forensic evidence.
In Santa Singh v. State of Punjab (1956), the Supreme Court ruled that unexplained delays in dispatching seized exhibits to the forensic laboratory, or the failure to prove that seals remained intact throughout transit, render the scientific report unsafe to rely upon. Such lapses open the door to the possibility of tampering or substitution of evidence.

The legal consequence depends upon the nature of the defect, the applicable law, and whether the prosecution can nevertheless establish the identity and integrity of the evidence to the standard.
